(e) Unless Mantas Digital authorises in writing, you may not use any manual or automated systems or software to extract or collect data from the Website, our software or other interfaces through which we provide our services.

3. Disclaimer of warranties and limitation of liability

Mantas Digital provides information and software (“materials”) on an “as is” basis. Mantas Digital makes no warranties of any kind, either expressed or implied, including any implied warranties of merchantability or fitness for a particular purpose, latent or patent defects, the presence of viruses, or the accuracy or absence of errors in the data or programs used or provided to the Bank or to you under this Agreement. Without limiting the foregoing, the Bank makes no representation or warranty, express or implied, against the infringement of the proprietary rights of any other party. You assume all risks relating to the quality and performance of the software, the adequacy of the information and any documentation. This clause shall survive the termination of this Agreement by both the Account Holder and the Bank and shall also limit the liability of any agent, employee or branch of the Bank. We do not and cannot guarantee that the software will be error-free or that all services will always be available and functional. Except as specifically set out in this agreement or as required by law, you agree that our officers, directors, employees, agents or contractors shall not be liable for any indirect, incidental, special or consequential damages arising out of or in connection with the services or products provided under this agreement, or out of or in connection with your use of, or access to, the website or the software, including any loss of profits, revenue, data or use, to you or to any third party, whether in contract or tort or under warranty. In addition, in no event, unless otherwise specifically stated in this Agreement, should the liability of the Bank and its affiliates exceed the amounts paid by you for services provided through a website or software owned by Mantas Digital.

4. Termination of the licence

In the event of any breach of the terms, conditions or restrictions, Mantas Digital may terminate the licence at any time. Upon termination of your viewing of these materials or termination of this licence, you must destroy all downloaded materials in your possession, whether in electronic or hard copy form. Failure to do so will result in a fine of €10,000.

5. Accuracy of materials

The information contained on Mantas Digital’s website or software may include technical, factual or photographic errors. Mantas Digital is not responsible for the accuracy, completeness or timeliness of any materials on its website or software. Mantas Digital may make changes to the materials contained on its website at any time without notice. However, Mantas Digital does not undertake to renew the materials.

Compliance with these terms and conditions shall be governed by the laws of the Republic of Lithuania and you irrevocably submit to the exclusive jurisdiction of the courts located in this place.
